These general terms and conditions of sale define the rights and obligations of the parties in the context of the sale of products on the website https://ayada-boutique.com/

ARTICLE 2 - SCOPE OF APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by AYADA BOUTIQUE ("the Seller") with consumers and non-professional buyers ("the Clients or the Client") (also individually referred to as "a Party" and collectively as "the Parties") wishing to acquire the products offered for sale by the Seller ("the Products") on the website https://ayada-boutique.com/

They notably specify the conditions of order, payment, delivery, and management of any returns of Products ordered by Clients.

These General Terms and Conditions of Sale may be supplemented by special conditions, stated on the website, before any transaction with the Client.

These General Terms and Conditions of Sale are systematically communicated to any Client prior to placing an order and shall prevail, where applicable, over any other version or contradictory document.

They are accessible at any time on the website https://ayada-boutique.com/.

The Client declares having read and accepted these General Terms and Conditions of Sale before placing an order. Validation of the order by the Client constitutes acceptance without restriction or reservation of these General Terms and Conditions of Sale.

As these General Terms and Conditions of Sale may be subject to later modifications, the version applicable to the Client's purchase is that in force on the website at the date the order is placed.

Article 3 - PRODUCTS OFFERED FOR SALE

The Products offered for sale on the website https://ayada-boutique.com/ include ready-to-wear clothing, shoes, accessories, perfumes, and any other products displayed on the website for commercial purposes.

The main characteristics of the Products are indicated in the product sheets. The Client is required to read them before placing any order.

The photographs and graphics presented on the website https://ayada-boutique.com/ are not contractual and do not engage the responsibility of the Seller.

The contractual information is presented in French and is confirmed at the latest at the time of order validation by the Client.

Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Client.

The Client acknowledges having the required capacity to contract and acquire the Products offered on the website.

Article 4 - ORDERS

Placing an Order
It is the Client’s responsibility to select the Products they wish to order on the website https://ayada-boutique.com/, as follows:

Cart Creation: The Client selects the Product(s) they wish to order by selecting the size, color, and clicking “Add to cart” (or equivalent).

Cart Review: The Client can at any time access the contents of their cart to verify the specifications of each selected product as well as the price, total discount (if the product is part of a promotional offer), and total price including VAT. It is the Client’s responsibility to check the accuracy of the order and to immediately report or correct any error. This validation implies full acceptance of these General Terms and Conditions of Sale.

Order Validation: The Client must tick the box “I have read and accept the general terms and conditions of sale” (or equivalent) and proceed to billing and payment.

The sale is final only after the Seller sends a confirmation email accepting the order, without delay and after full payment has been received.

Any order placed, validated by the Client, and confirmed by the Seller under the conditions described above on the website https://ayada-boutique.com/ constitutes a contract concluded remotely between the Client and the Seller.

The Seller reserves the right to cancel or refuse any order from a Client with whom there is a dispute relating to payment of a previous order.

The Client can track the status of their order on the website https://ayada-boutique.com/.

Order Modification
Once confirmed and accepted by the Seller, under the conditions described above, the order cannot be modified.

Order Cancellation by the Client
Once confirmed and accepted by the Seller, under the conditions described above, the order cannot be canceled, except in cases of exercising the right of withdrawal or force majeure.

Order Cancellation due to Out of Stock
In the event of an out-of-stock situation not indicated on the website, the order may be canceled. If the Client wishes, equivalent products may be offered. If the Client refuses these replacement products or if none are available, a full refund will be issued promptly.

Article 5 - PRICING

The Products are supplied at the current prices listed on the website https://ayada-boutique.com/ when the order is registered by the Seller. Prices are expressed in Euros, excluding and including VAT.

Depending on the Client's country of residence, any change in legal tax rates will be applied and reflected in the total amount to be paid.

Prices include any discounts offered by the Seller on the website at the time of the order.

These prices are firm and non-revisable during their validity period as indicated on the website https://ayada-boutique.com/. The Seller reserves the right to change prices outside this validity period at any time. Prices do not include processing, shipping, transportation, and delivery fees, which are charged additionally, as indicated on the website https://ayada-boutique.com/ and calculated prior to the order.

Depending on the Client’s country of residence, additional charges may apply due to local regulations (such as currency conversion fees, card fees, sales taxes, customs duties, etc.). These charges are non-refundable, even in the case of a return.

Here is a (non-exhaustive) list of fees that may be updated by the service providers:

Payment by credit card:

• 1.8% + €0.25 for European cards

• 3% + €0.25 for UK cards

• 3% + €0.25 for international cards

Payment via Scalapay:

• 3.99% + €0.30

If the Client requests a faster or more expensive shipping method than standard delivery, the additional processing, shipping, transportation, and delivery costs calculated before the order validation will be fully borne by the Client.

The amount requested from the Client corresponds to the total purchase amount, including these fees.

An invoice is issued by the Seller and delivered to the Client upon delivery of the ordered Products.
